Information on road transport

The road related authority tasks on first instance are carried out by the territorially competent Regional Directorate, Department for Transport Subsectors, while on the second instance by the Central Office Department of Second Instance Authority. Within the Regional Directorate's Department for Transport Subsectors working groups are operating at the county towns with a competency covering the given county.

The authority tasks on first instance

The Directorate of High Priority Affairs, National Transport Authority with a competency for the whole country manages issues related to clearway network belonging to the national public road network, border crossing points, and bridges with distance over 30 meters between the pillars. Licensing the establishment, relocation, abolishment of grade crossings on normal-gage national public railway, and on national public roads- except temporary established grade crossings- belongs to the same organizational unit.

In regard of roads in Budapest owned by the Municipality of the Capitol the Regional Directorate for Central Hungary, while in case of road owned by the district Municipalities the town clerk is the competent transport authority. 

Road speciality licenses among others the building and abolition of roads, conducts proceedings - initiated on road operator's request - concerning road usage for not transport purposes. Road speciality decides in case of national roads on measures or denial of measures violating road operator's interest. The transport authority considers the conditions prescribed by the road operator to develop road connections, on appeals of clients.   

Building, modernizing, abolishing, demolishing, opening for traffic of roads is only allowed based on the authorization of the transport authority. Anyone acting against or not according to the permits' content are to be fined by the transport authority and obliged to restore the original state. This regulation is binding besides national and local public roads for private roads opened for public transport as well.  

Application for permits and licenses are to be submitted at the territorially competent Regional Directorates's Department for Transport Subsectors. In Budapest application for permits and licenses in case of  roads  belonging to the competency of the National Transport Authority are to be submitted at the Department for Transport Subsectors, Regional Directorate for Central Hungary (Budapest, XIV. ker. Komócsy u. 17-19.) . In county towns, which are not region centers the application for permits and licenses can also be submitted at the territorially competent Regional Directorates's Department for Transport Subsector local working group.

Licensing of road construction is regulated by the decree number 15/2000. (XI. 16.) KöViM. There is a possibility to ask for theoretical building permit before submitting an application for a building permit. We need full permit documentation as prescribed by the law to be submitted to be able to complete our  proceedings quickly and successfully.

Proceedings fee has to be paid at the time of application's submission, or after it  is submitted in accordance with the proceeding authority's billing rules. (Decree number 26/1997. (XII. 12.) KHVM). With post-payment of the fee the actual permit proceeding begins after the (proof of) payment.

Plan documentation for application of road building permit can be carried out by designer registered in the designer name list and having the appropriate rights.
